These Terms of Use ("Terms") govern your use of the Lumiere: AI Skincare Scanner iPhone application and this website (together, the "Service"), operated by Knyaz Harutyunyan. By downloading or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Lumiere on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell or redistribute the app, or use it to build a competing product.
2. Not medical advice
Lumiere provides cosmetic-ingredient information and product-compatibility guidance. It is not a medical device and does not provide medical advice, diagnosis or treatment. Analyses, match scores and AI chat responses are informational only and may be incomplete or wrong.
Always read the manufacturer's own packaging and follow its directions, and patch-test new products. Consult a qualified healthcare professional for persistent acne, suspected rosacea, eczema or dermatitis, any changing mole or lesion, any reaction that does not settle, and before changing your routine during pregnancy, while breastfeeding, or while using prescription treatments. If you have a severe reaction, seek medical attention. Never disregard professional medical advice because of something you read in the Service.
3. Accuracy
Ingredient scanning relies on camera-captured text, which can be misread on small, curved, reflective or worn packaging. Formulations change without notice, and ingredient science evolves. We make no warranty that any analysis, score, shelf-life estimate or chat response is accurate, complete or current. Shelf-life estimates are guidance based on typical category values, not a guarantee of product safety — the manufacturer's own dates and symbols always take precedence.
4. Subscriptions and billing
- Lumiere is free to download. Some features require a paid subscription.
- Subscriptions are sold and billed by Apple through your Apple ID. We do not process or store your payment details.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price for the plan you selected.
- Manage or cancel a subscription in iOS Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.
- Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
- Prices may change; we'll give notice as required and any change applies from the next billing period.
5. Refunds
Purchases are handled by Apple, so refunds are governed by Apple's policies. Request one at reportaproblem.apple.com. We cannot issue refunds for App Store purchases directly.
6. Your account and content
You're responsible for the accuracy of the information you enter and for keeping your device and Apple ID secure. You retain ownership of the content you create in the app, including journal photos and notes. You grant us a limited licence to process that content solely to operate the Service for you, as described in the privacy policy.
7. Acceptable use
You agree not to use the Service to break any law; to upload unlawful, abusive or infringing content; to attempt to gain unauthorised access to our systems; to scrape, bulk-download or systematically extract data from the Service; to interfere with its operation; or to use it for any commercial purpose we haven't authorised in writing.
8. Intellectual property
The Service, its design, the Lumiere name and logo, and all associated software and content are owned by us or our licensors and protected by intellectual property law. Nothing in these Terms transfers any of those rights to you. Third-party brand and product names referenced in analyses belong to their respective owners and are used descriptively only; their appearance does not imply any affiliation with or endorsement of Lumiere.
9. Third-party services
The Service relies on third-party providers, including Apple and cloud and AI infrastructure providers. We're not responsible for their acts, omissions or availability.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD 50.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, and these Terms do not affect statutory consumer rights you may have.
12. Termination
You may stop using the Service at any time and delete your account in the app's settings. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will do so.
13. Apple-specific terms
- These Terms are between you and us, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim relating to the app, including product liability, regulatory non-compliance, or consumer protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You confirm you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and are not on any US Government restricted-parties list.
14. Changes to these Terms
We may update these Terms and will revise the date at the top. Continuing to use the Service after changes take effect means you accept them.
